New York Partner Prevails in Premises Liability Case for Property Owner

New York City Partner Sean H. Chung obtained summary judgment at the Supreme Court of Queens County in a premises liability case on behalf of our property owner client.

Plaintiff, a tenant at our client’s apartment complex, slipped and fell at the building entrance, and claimed they suffered serious injuries that resulted in multiple significant surgeries. Plaintiff attributed their fall to ice that they alleged our client failed to clear. Consequently, Plaintiff filed suit against our client and sought a multi-million dollar recovery for their injuries.

Plaintiff’s counsel claimed that the apartment entranceway contained a structural defect that caused water to pool, and contributed to the alleged ice formation. Sean successfully argued that this claim was speculative due to Plaintiff’s testimony that they had no knowledge regarding the source of the alleged ice. Furthermore, Sean contended that our client did not have actual or constructive notice of the alleged condition of the entranceway. In March 2023, the Supreme Court granted Sean’s motion and entered a judgment in favor of our client.
