Massachusetts Attorneys Obtain Unanimous Defense Verdict in Personal Injury Case

Boston-area Partner Angela L. Linson and Attorney Gayatri R. Deodhar obtained a unanimous defense verdict at the Suffolk County Superior Court in a personal injury case on behalf of our hotel client and its shuttle bus driver employee.

In September 2019, the 75-year-old Plaintiff was crossing the street at the airport in Boston, Massachusetts, when she was struck by a hotel shuttle bus driven by our client’s employee. The Plaintiff claimed that she suffered injuries as a result of this accident that would require her to undergo a laminectomy and spinal fusion surgery. Subsequently, the Plaintiff filed suit against our client.

At the February 2023 trial, Angela and Gayatri argued that there was a large cement pillar where the impact occurred that blocked the Plaintiff from the view of oncoming drivers. In addition, there was a railing to prevent pedestrians from crossing the street in this area, as well as a bend in the road and no crosswalk. Our attorneys were able to show that our client’s driver was unable to stop the shuttle bus in time to avoid impact due to the Plaintiff abruptly stepping out from behind the cement pillar, and into the street.

The unanimous jury took less than 90 minutes to find that our client was not negligent.
