CT Attorney Reviews Order Providing Immunity for Healthcare Providers During COVID-19

Connecticut attorney Jacqueline A. Maulucci has written a current Litchfield Alert that discusses an executive order signed by Connecticut Governor Ned Lamont that limits liabilities of healthcare providers during the current coronavirus crisis. Executive Order No. 7U, retroactive to March 10, 2020, grants immunity from civil liabilities to healthcare professionals and certain facilities that occur during the COVID-19 pandemic. Gov. Lamont’s order follows similar orders signed by the governors of the states of New York and New Jersey.

Jacqueline states that the language within Order 7U appears to set a high bar of liability for healthcare providers, though it remains unclear if such language will be upheld once lawsuits are filed and argued in the coming years. While the order may provide protection for front line healthcare workers, it may not necessarily provide the level of protection the same providers and care facilities anticipate.
