Georgia Partner Featured in DRI Magazine

Atlanta Partner Brenton S. Bean authored an article in the Defense Research Institute’s (DRI) For The Defense (FTD) magazine titled, “You Can’t Say That!, Compelling Free Speech Issues before the Supreme Court.” Brent’s contribution was featured in the July & August 2023 issue of the publication.

In Brent’s article, he provides insight into the Supreme Court’s recent interpretation of the government’s efforts to regulate free speech—specifically, addressing technological advancements. He shares an overview of free speech rights and how these rights apply to content-based restrictions, compelled speech and viewpoint discrimination.

Brent also details several pending Supreme Court cases involving First Amendment issues, and how the rulings on those matters will determine how free speech is safeguarded or restricted. Brent states, “where the government regulates speech based on the ideology of the speaker it is a more egregious form of content discrimination. Targeting not only subject matter but particular views taken by speakers on a subject is a blatant violation of the First Amendment.”

Brent focuses his practice on defending employers in both the private and public sector in state and federal courts nationwide. He handles employer-related matters such as wage and hour claims, employee/independent contractor issues, disability and leave cases, and state law tort claims. Brent defends clients in disputes involving enforcement and non-compete, non-solicitation and confidentiality agreements.
